Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of foreverhomesmedia.com, our online order page and blog, and to the real estate photography, video, drone, floor plan, 3D tour, property website and editing services provided by Forever Homes Media ("we," "us" or "our"). By using our website or booking a service, you agree to these Terms and to our Privacy Policy. "You" means the person or business booking or using our services, such as a real estate agent, brokerage or property owner.

Booking and pricing

You can book through our online order page or by calling, texting or emailing us. A booking is confirmed once we accept it and confirm a date and time. Prices are those shown on our order page at the time you book, and may change for future bookings. Larger properties, travel outside our usual service area, or special requests may cost more, and we'll tell you before the shoot if they do.

Property access and getting ready

You're responsible for making sure we have permission to enter and photograph the property, including any needed consent from the owner, tenants or HOA, and for giving us working access at the scheduled time. Please have the property ready before we arrive: lights on, blinds open, counters and personal items cleared, and cars out of the driveway. If the property isn't accessible or ready, we may need to reschedule.

Please tell us in advance about pets, alarm systems, gate codes, or anything at the property that could affect our safety or the shoot.

Rescheduling, cancellations and weather

If you need to reschedule or cancel, please let us know as early as possible. Any fees for late changes, cancellations or trips where we can't access the property will be shown on our order page or confirmed with you when you book. We may reschedule exterior, twilight or drone work because of rain, high winds, poor light or other conditions that would hurt the results or make work unsafe. We'll work with you to find the next available time.

Drone services

Drone photos and video are flown in line with FAA rules and local restrictions. Some locations, such as areas near airports, controlled airspace or temporary flight restrictions, may limit or prevent flights, and we may also cancel or cut short a flight for weather or safety. When that happens we'll let you know your options, such as rescheduling or replacing drone shots with ground photos.

Delivery and revisions

Finished media is delivered electronically, usually through a download link or property website. Delivery times vary by service, and we'll let you know the expected timing for your order. If something in your delivery doesn't match what you ordered, contact us promptly and we'll work with you to fix it.

Property websites and hosted tours stay online for the period described with the service. We're not responsible for third-party platforms, such as Zillow, Matterport or MLS systems, changing or removing content.

Payment

Payment is due as shown on your order page or invoice. Payments are processed by our booking and payment providers. We may hold delivery of media until the balance is paid. Unpaid balances may be sent to collection, and you agree to cover reasonable costs of collecting past-due amounts where the law allows.

Who owns the media and how you can use it

We keep the copyright to all photos, video, floor plans, tours and other media we create. Once your order is paid, we give you a non-exclusive, non-transferable license to use the media to market the specific property it was created for, including on the MLS, listing websites, print materials, social media and your own marketing about that listing.

You may not sell, sublicense or give the media to others, such as another agent, a builder or a publication, for their own use without our written permission. If a listing changes agents, the new agent will need to contact us for a license. We may use the media in our own portfolio, website and marketing. If you need different usage rights, ask us and we'll work it out in writing.

Edited images and disclosure

Some services, such as virtual twilight, virtual staging and object removal, digitally alter images. California law (AB 723, effective January 1, 2026) requires real estate ads that use digitally altered images to disclose the alteration and give access to the unaltered image. You're responsible for meeting disclosure rules wherever you use the media, and for not using edits in a way that misrepresents the property. Please keep the original, unedited versions we deliver.

Text messages

If you agree to receive texts from us, we'll send messages about appointments, orders and occasional updates. Message frequency varies, usually no more than 2 to 4 messages per month. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not required to buy any service. See our Privacy Policy for how we handle your information.

Using this website

The content on this website, including text, photos, video, logos and design, belongs to Forever Homes Media or our licensors and may not be copied or reused without permission. You agree not to misuse the site, interfere with how it works, or try to access it in unauthorized ways. Our website may link to sites we don't control, and we're not responsible for their content or practices. We try to keep website information, including pricing, accurate and current, but it may contain errors, and the order page and your confirmation control.

Disclaimers and limits of liability

Our services and website are provided "as is." We don't guarantee any particular result from using our media, such as a faster sale or a higher price. To the fullest extent the law allows, we're not liable for indirect, incidental or consequential damages, including lost commissions or profits, and our total liability for any claim related to a service is limited to the amount you paid for that service. If media is lost or can't be delivered because of equipment failure or other events, our responsibility is limited to reshooting the affected work or refunding what you paid for it.

You agree to hold us harmless from claims that arise from your use of the media in a way these Terms don't allow, from missing permission to access or photograph a property, or from inaccurate information you give us.

Governing law

These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Riverside County, California. If any part of these Terms is found unenforceable, the rest stays in effect.

Changes to these Terms

We may update these Terms from time to time. The version posted on this page when you book applies to that booking.
